1. Introduction
Welcome to Decimly. These Terms of Service ("Terms") govern your use of the Decimly platform and services (the "Service"), accessible at www.decimly.com, operated by an individual auto-entrepreneur registered in France. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. Description of the Service
Decimly is a SaaS marketing analytics platform designed for marketers, solo founders, and growth teams. Decimly helps you understand your campaign performance by comparing data from multiple sources in a unified dashboard. It is strictly a data analysis and comparison tool.
2.1 What Decimly Does
- Reads data from Google Analytics and Google Ads to display it in a unified view
- Compares metrics between ad platforms and your site analytics
- Calculates reliability levels to help you understand data discrepancies
- Provides AI-powered analysis when you request it, explaining gaps between platforms
- Allows manual campaign tracking for non-Google platforms
- Helps you make informed decisions about your marketing strategy
2.2 What Decimly Does NOT Do
- Decimly never creates, modifies, pauses, or deletes any campaigns, ad groups, ads, or keywords in your Google Ads account
- Decimly never changes your budget or bidding settings
- Decimly never makes automated decisions on your behalf
- Decimly is not an ad management platform — it is strictly read-only
Important: All actions on your Google Ads account must be performed directly in Google Ads. Decimly provides analysis and insights to inform your decisions, but you remain fully responsible for any changes you make to your advertising accounts.
3. User Accounts & Authentication
To use the Service, you must create an account. Decimly offers account creation via Google OAuth 2.0 (Google Sign-In) or email registration. When you sign in with Google, we access only your email address, name, and profile picture for authentication and account personalization purposes. By creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Not share your account with third parties or create multiple accounts
We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner inconsistent with the intended purpose of the Service.
4. Third-Party Integrations
Decimly integrates with third-party services including Google Analytics and Google Ads. By connecting these services:
- You authorize Decimly to access data from these platforms in accordance with our Privacy Policy
- You confirm that you have the necessary rights and permissions to share this data
- You understand that Decimly's analysis depends on the accuracy of data from these platforms
- You can disconnect integrations at any time from your Settings page
Decimly is not responsible for the availability, accuracy, or changes to third-party APIs. If Google changes their API, certain features may be temporarily or permanently affected. We will endeavor to communicate any such disruptions promptly.
5. Subscription Plans, Payments & Billing
Decimly offers various subscription plans, including a free tier and paid options.
5.1 Free Plan
The free plan provides limited access to Decimly's features. No credit card is required to sign up. Feature limitations of the free plan are described on our Pricing page.
5.2 Paid Plans
For paid subscriptions:
- All payments are processed securely through Stripe. We do not store your full credit card details.
- Subscriptions are billed in advance on a recurring monthly or annual basis, depending on the plan you select
- Prices are displayed in EUR and include applicable taxes where required
- Your subscription automatically renews at the end of each billing period unless cancelled
- We may change prices with at least 30 days prior notice via email. The new price takes effect at the next renewal.
5.3 Cancellation & Refunds
- You may cancel your subscription at any time from your account settings or by contacting support@decimly.com
- Upon cancellation, you retain access to paid features until the end of your current billing period
- No partial refunds are issued for unused time within a billing period, except where required by applicable law
- After the billing period ends, your account reverts to the free plan
6. AI-Powered Features
The Service includes AI-powered analysis and recommendations. Important considerations:
- On-demand only: AI analysis runs when you explicitly request it, not automatically
- Advisory only: AI insights are informational and should not be considered professional marketing, financial, or business advice
- Your responsibility: You remain fully responsible for your marketing decisions and campaign strategies
- No guarantees: AI recommendations do not guarantee any specific marketing or financial results
7. Data Accuracy and Reliability
Decimly calculates "data reliability levels" by comparing metrics across platforms:
- These levels indicate how consistent your data is across sources, not absolute correctness
- Discrepancies between platforms are normal and expected in digital marketing
- Decimly helps you understand these discrepancies but cannot eliminate them
- Always use multiple data sources when making significant business decisions
8. User Responsibilities & Acceptable Use
As a user of the Service, you are responsible for:
- Ensuring the accuracy of data you manually input into the platform
- Maintaining the confidentiality of your account credentials
- Any decisions you make based on the analysis or AI insights provided by Decimly
- Ensuring you have proper authorization to connect third-party accounts (e.g., Google Analytics, Google Ads)
- Complying with all applicable laws and regulations in your use of the Service
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious content or code
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to mislead others about campaign performance
- Resell, sublicense, or redistribute access to the Service without authorization
9. Intellectual Property
You retain ownership of the data you input into the Service. You grant Decimly a limited, non-exclusive license to use, process, and store your data solely to provide the Service. The Decimly platform, including its design, features, code, branding, and all associated intellectual property, remains the exclusive property of Decimly. Nothing in these Terms grants you any right to use Decimly's trademarks, logos, or branding.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Decimly does not guarantee that the Service will be uninterrupted, secure, or error-free. We do not guarantee any specific results from using the Service. The analysis and insights provided are for informational purposes only and do not constitute professional advice.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Decimly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, or business opportunities
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim
- Decimly is not responsible for decisions you make based on our analysis or AI recommendations
- Decimly is not responsible for any losses related to your advertising campaigns, marketing strategies, or business outcomes
- Decimly is not liable for interruptions, errors, or inaccuracies in third-party data provided by Google Analytics or Google Ads
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.
12. Account Termination & Suspension
Termination by you:
- You may cancel your subscription at any time from your account settings
- You may request full account deletion by contacting support@decimly.com with the subject "Account Deletion Request"
- Upon account deletion, all your data will be deleted in accordance with our Privacy Policy (Section 11)
Termination or suspension by Decimly:
- We may suspend your account temporarily if we detect security issues or suspicious activity
- We may terminate your account if you materially breach these Terms, engage in abusive or fraudulent behavior, or fail to pay for a paid subscription after reasonable notice
- In case of termination for cause, we will provide you with reasonable notice when possible
Upon termination, your right to use the Service ceases immediately. If you have a paid subscription, no refund will be issued for the remaining billing period unless required by applicable law. We will delete your data in accordance with our Privacy Policy.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we will also notify you via email at least 30 days in advance. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in France. Before initiating any legal proceedings, you agree to attempt to resolve disputes amicably by contacting us at support@decimly.com.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
